Program Description
BioGeoTechnics may send SMS communications to individuals who voluntarily opt in through our website forms or other communication channels. Messages may include responses to inquiries, appointment reminders, recruiting and hiring communications, service-related updates, event communications, and other relevant business communications.
Opt-Out Instructions
You may cancel the SMS service at any time by replying STOP to any message received from BioGeoTechnics. After sending STOP, you will receive a confirmation message stating that you have been unsubscribed. You will no longer receive SMS messages from BioGeoTechnics unless you opt in again.

Wireless carriers are not liable for delayed or undelivered messages.
Costs and Message Frequency
Message and data rates may apply to messages sent to you by us and messages sent by you to us. Message frequency varies based on your interactions with BioGeoTechnics.
Users may receive up to four (4) messages per month relating to inquiries, recruiting processes, appointments, service communications, or other business-related matters. For questions regarding your text or data plan, please contact your wireless provider.
Privacy and Consent
By providing your mobile phone number and opting in, you expressly consent to receive SMS communications from BioGeoTechnics at the number provided. Consent is not a condition of purchasing any goods or services.

Indemnification

- ANY SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES RELATED TO YOUR USE, MISUSE, OR INABILITY TO USE OUR SERVICES;
- ANY INTERRUPTION IN THE USE OF OUR SERVICES OR LOSS, DESTRUCTION, OR CORRUPTION OF DATA; OR
- ANY RELATED LOSS OF REVENUE, PROFITS, BUSINESS, OPPORTUNITY, OR GOODWILL.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE PRIVACY POLICY, THESE TERMS, OR YOUR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE TOTAL AMOUNT YOU PAID US FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Termination of Services
We may, in our sole discretion, restrict or terminate your access to all or part of the Services, deny Services, suspend or permanently delete your account, or discontinue any portion of the Services at any time, with or without reason and with or without prior notice.

YOU AGREE THAT ALL CLAIMS, EXCEPT CLAIMS RELATING TO INTELLECTUAL PROPERTY, WILL BE RESOLVED THROUGH BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION.
IF YOUR CLAIM QUALIFIES FOR SMALL CLAIMS COURT, YOU MAY BRING THE CLAIM IN SMALL CLAIMS COURT INSTEAD OF ARBITRATION.
ANY CLAIM THAT IS NOT ARBITRATED OR RESOLVED IN SMALL CLAIMS COURT WILL BE RESOLVED EXCLUSIVELY IN THE STATE COURTS LOCATED IN DELAWARE OR THE UNITED STATES DISTRICT COURT LOCATED IN DELAWARE.
YOU AND BIOGEOTECHNICS EXPRESSLY WAIVE THE RIGHT TO A TRIAL BY JURY.
